Rushford Town Board Minutes

The Town of Rushford June Board meeting was called to order at 7:00 pm by Chairman Thomas Egan followed by the Pledge of Allegiance.  Roll call was taken with Tom Egan, Jerry Schoonover, Kathryn Lewis, and Peggy Hendricks present.  Also present for all or part of the meeting: 11 additional persons per attendance record on file, although several others were present, but did not sign in. (Supervisor Kafer came at 7:30 after a previous engagement)

 

Statement of Public Notice:   Notice of this meeting and the zoning-planning committee meeting was posted at the Town Hall, the Waukau post office and the Eureka Post office building.  In addition Open book, the Board of Review, Public zoning hearing notice and the testing of election equipment was published in the Oshkosh Northwestern.  Notices were mailed to Town Board members and the Zoning Administrator.  

 

Sheriff’s Department representative:   No one was present.

 

 Clerks Report & Minutes:    Motion by Schoonover, 2nd by Egan to approve the minutes as presented for the May 2nd Town board meeting.  Motion carried.

 

Treasurers Report was given by Kathryn Lewis.  The balance at the end of May in the general account is $317,749.53.  Motion by Schoonover, 2nd by Egan to accept the treasurer’s report.  Motion carried. 

 

Payment of invoices:  Peggy Hendricks approved and submitted to the board the bills for June in the amount of $27,102.09 for approval of payment.  Motion by Schoonover 2nd by Egan to pay Junes bills as submitted.  Motion carried. 

 

Public Input:  Wendi Laverenz inquired if the Eureka Ball diamond was privately owned, which it is by Mary Pohlmann.

Patsy Pomplun inquired why her copies of her CSM were on the back counter.  They were accidently placed out with the other information.

 

Communications & Correspondence: 

·         Letter by Michels informing the Town they would be blasting the week of May 7 for approximately one month.

·         Notice from Winnebago County Treasurer - notice of sale for tax delinquent real estate in the Town of Rushford parcel # 22 0702-02, River Road, Berlin Wi – minimum bid $9,000

 

Discussion of Hall maintenance:  

·         Peggy Hendricks stated the flag pole is now straight and special thanks to Kafer Farms for donation of equipment.

·         Mr Egan talked to Traxlers and they were out yesterday to mow and they dug out the bull thistles.  They stated wild flowers are coming up and it should be mowed a couple of times a year after this.

·         Tom Egan stated that DKAL will be looking at the light that shines on the flag and on the building, the burned out light in the parking lot and the power outlet.

 

Discussion of Town maintenance:  

 

Roads & Brushing: 

·         Tom Egan and possibility other members of the board will be meeting with the Highway Department June 7 at 8:00 am to go over with them the road work for 2012.  The first road that will be done is Bell School Road.  The Board went though the work that should be done this year and the cost will be approximately $230,000.

·         Sergeant Reinhart from the Correctional Department stated that they will not be able to schedule any crews until November 2012.  They could not finish up for the parks Dept. needed the chipper.  He figured 3 roads that were not cut and a couple others that did not get chipped. 

·         Ripon Trucking will have the first mowing done by July 4th.

·         A stop sign that was broke at Senn & Delhi was repaired.

·         A letter was received by Winnebago County Highway Commission informing us that they were taking Culvert Aid applications at this time.  The minimum size culvert is 36”.  The Town does not have anything at this time. 

 

New Business: 

·         Motion by Schoonover, 2nd by Egan to reschedule Julys Monthly Board meeting for July 11th, since the first Wednesday falls on July 4th.  Motion carried.

·         Motion by Schoonover, 2nd by Egan to approve the Class B Beer & Liquor License applications for The Landings Bar & Grill, Starlight Bar, Bill & Stels,  O’Malley’s and Trails Inn.  Motion carried.

·         Motion by Schoonover, 2nd by Egan to approve applications for picnic licenses for the Flying Mane, Waukau Community Center, Omro Police Department, Eureka Landings, Eureka Snowmobile Club and Past Tymes.  Motion carried.

·         Jim Smith from Martenson & Eisele was present to petition the Town Board, on behalf of James Schoonover, to vacate part of an unimproved alley in Waukau.  Jim Schoonover owns property at 2608 STH 116 where this is located.  The alley they are requesting to be vacated is located east of STH 116 and south of Mechanic Street in the Original Plat of Waukau.  There are three other property owners adjacent to this alley.  A formal process is needed to vacate.  Peggy Hendricks will meet with Attorney Blazel to give him the information to go through the process to vacate the alley.  Mr Egan informed Mr Schoonover that he will be liable for all cost of vacating the alley.  Mr Egan also stated that the other 3 land owners would have to sign off and agree to this.  Mr Smith thought before we could proceed, that they would need the OK from the Town.  Mr Egan said before the town could consider this; approval would have to be received in writing from the other property owners.

·         Peggy Hendricks received an email from the Celebration Women’s Ministries looking to rent the Town hall for their group is too large for their present meeting place.  The events are from 6:30 am to 11:00 am.  Motion by Kafer, 2nd by Schoonover to allow the Eureka Celebration Women’s Ministries to rent the hall for $20 per event unless there is conflicting activity.  They would then be able to secure their date, but at $50 instead of $20.  Motion carried. 

·         Tom Egan stated that Peter Steger, 2871 County Highway E, Berlin is operating a business on his property.  Fred Kasten and Tom Egan has spoke to him informing that he would either need to apply for a Conditional Use permit or rezone his property.  Pat Kafer said if this building was intended to be used for commercial business, it should have been built to commercial specs and be inspected.  Motion by Schoonover, 2nd by Kafer to have the clerk send a letter to Peter Steger informing him he is in violation of running a business on his property and he must apply for a Conditional use permit or rezone his land for Commercial.  Motion carried.

·         Curtis Yonke was on the agenda, for he was at the Board of Review asking for a refund of taxes paid in 2011.  He was informed at that time that the Board of Review can only act of present tax amounts and was told to come to the Board meeting, for this is a Board decision.  Mr Yonke was not present.  Mr Egan felt he had plenty of notice and he will not be put on the agenda for July.    

 

 

Town Zoning Committee Report – Dan Stokes:  Mr Stokes reported that they met on May 30.  The zoning committee recommended approval to the Town Board to change #022 0191 from A-1 to A-2, and #022 0191-02 from A-3 to A-2 for Albright Bros.

 

Mr Dan Schmitz was present to explain he is interested in purchasing land on Hwy 116 and K.  He lives in Omro and would like to put up a storage unit for his antique vehicles.

 

Patsy Pomplun presented a tentative CSM of their property to inform the planning committee what they were thinking of doing.

Tom Egan requested that the agenda next month should include Steger Repair on Hwy E.  He is advertising for business and he does not have a Conditional use permit or he should rezone his land to Commercial.

 

Mr Ken Stertz was present with concerns about Fox Valley Heritage Parkway and the affect it would have on Fox River landowners.

 

Motion by Kafer, 2nd by Schoonover to approve the zoning change for Albright Bros, parcel # 022 0191 from A-1 to A-2, and #022 00191-02 from A-3 to A-2. Motion approved.  Motion by Schoonover, 2nd by Kafer to approve the CSM for Albright Bros as presented.  Motion carried.

 

Town Assessor Report – Larry Timm:  Mr Timm was not present, but Mr Egan stated they had one person at Board of Review and Peggy Hendricks stated a good turnout was present at Open Book.

Pat Kafer suggested a new chair be purchased for the board chairs, for it seems to be broke. 

 

Tom Egan stated that he was called by the Waushara County Police, for there is a parcel on 36th St, Berlin, WI that does not have a 911 Emergency number.  They are using the farm number which is not from the Town of Rushford.  Pat Kafer thought he had that fire number.

 

Reports on Meetings that have been attended:  

 

·         Peggy Hendricks reported the May 8th election had 410 voters which was a 43.4% turnout and June 5th election had a 80.56% turnout.  The County as a whole had a 73% turnout which was higher than the 2008 presidential election.

 

 

Motion by Kafer, 2nd by Schoonover to adjourn at 8:10.  Motion carried.
