Slow, No wake ORDINANCE

 

 

 

Discussion

Fred Kasten said Winnebago Co Sherriff’s Department, the DNR and our constable has the authority to enforce the no wake ordinance and write out a citation.  Peggy Hendricks said she will have Berlin Printing make up a generic citation booklet for violations in the township.  Kasten mentioned that the DNR issues a warning first and the 2nd time, a citation is issued.  If they have a written complaint, they will go out and talk to the person.  Jan says there are a lot of problems up at Edingers Boat Landing. 

 

An application to the DNR has to be made for a buoy to be placed.  Tom Jackson will find out who puts the buoys out in Eureka.  Jan Clausen said the DNR issues citations for $175 for each offense.  They do not get a warning.  It was decided that we should raise the fine from $10 to the same as the DNR, of $175. 

 

Dean Kaderabek mentioned that we will need GPS coordinates on the buoys, when and who will be placing the buoys, and paper work from the DNR and Army Corp of Engineers.  He has concerns with Section 2 of the ordinance.  He thinks it should be reworded.  Dean will check with the DNR and the Army Corp of Engineers for documentation and he will also get a copy of Wolf River ordinance.

 

A 3-page, generic citation booklet was discussed.  It would also be good if the constable would have pictures in case it goes to court. 

 

Conclusions

Kafer & Hendricks will get GPS coordinates, Kaderabek will get documentation from DNR and Army Corp of Engineers, Jackson will find out who puts the buoys out in Eureka, Hendricks will work on a citation booklet, and Kaderabek will get a copy of the ordinance that Wolf River has.  Dean thought Section 2 would be purpose, move that up to the 2nd paragraph and then go to Section 1; Section 3 would be Section 2.  There will not be a first offense or 2nd offense.  There will be a flat fine and up to the constable if a warning is given.  Dean will also find out exactly what the DNR fine is. Then we will do an amendment to the ordinance.

Farmland preservation ordinance

 

Discussion

Kasten stated that Winnebago Co has hired someone to write a Farmland Preservation Ordinance.  Our exclusive Agriculture, A-1 and A-2 will be Farmland preservation districts.  All the grant money is going to the County.  All the townships farmland preservation ordinances and mapping will have to be certified.  Once the County has the ordinance wrote up, we can piggy back off that and just change to our name.  We will have the choice on what lands will qualify.  Right now it is 35 acres of continuous land.  We could change that to 10 A or whatever was decided.  We can decide what the maximum lot size will be. 

 

Kasten would like a farmland preservation map done.  The villages and commercial areas would be excluded.  Everything that is green on our map right now will be in Farmland Preservation Districts. 

conclusions

We will wait until the County has their farmland preservation ordinance draft done.  Dean will work on the map.  We will have to have an ordinance and a map to submit to the County.  It was thought we will be able to submit these ourselves instead of incurring attorney fees.

No Smoking ban

 

Discussion

Peggy Hendricks showed examples of other towns ordinances that were created for the new state wide smoking ban coming up in July.   

 

conclusions

It was decided not to do anything at this time as far as passing any additional smoking bans in the Town of Rushford.
