Public hearing on CONDITIONAL USE PERMIT FOR JOEL HARGRAVE, AGENT FOR TOM SCHUSTER, PARCEL # 022 060701

 

 

 

Discussion

Fred Kasten read the Public notice for the Conditional use permit application.  It was bought to the attention of the committee, that several parcels, including the one applying for the permit, does not have town zoning, even though it is county zoned.  It was suggested that the committee should designate what the zoning should be on those parcels. 

 

The reason why there was no town zoning, is that back in earlier times, it was thought the pond on parcel 022 0601 was connected to the river, which would make it all county zoning.  It was determined on November 17, 2010, that the pond is beyond 500 ft from a public waterway.

 

Dean asked what the business was on the parcel applying for the CUP.  It was explained that it is mostly a delivery service of Morning Glory products.  There is a refrigeration unit in the shed for products. 

 

Motion by Egan, 2nd by Clausen to apply A-3 zoning to parcel 022 060701.  Motion carried.

 

A-3 Zoning will be applied to:  Parcel 022 06070101, 022 060001, 022 0606, 022 0605, 022 060102, 022 06010501, 022 060105, 022 060103, 022 060104

 

A-2 zoning will be applied to:  Parcel 022 0600, 022 0607, 022 0603, 022 0616, 022 0604, 022 0601, 022 0608, 022 060108, 022 0436

 

On parcel # 022 0603, the county has half of this zoned Industrial.  It will all be changed to A-2.  This parcel is owned by Tom Schuster.  Parcel # 022 0608 will have the ball diamond grandfathered in for use without a Conditional use permit. 

 

Motion by Hildebrand to change zoning as the committee has marked on the map.  Motion resended.

 

 

Conclusions

Motion by Egan, 2nd by Hildebrand to apply zoning of Commercial to parcels 022 060107, 022 060101, 022 060106. Motion carried.

 

Motion by Hildebrand, 2nd by Clausen to apply the zoning to the remaining parcels as marked by the committee.  Motion carried.

 

 

Motion by Hildebrand, 2nd by Egan to grant the Conditional Use permit to Joel Hargrave on Parcel # 022 060701, located on 3220 Quarry Drive, Omro.  Motion carried.

NEW BUSINESS

 

Discussion

The Eureka Feed mill was discussed, for a resident had questioned if there were any fuel tanks in the building.  It was said that the tanks were located in the lean to and there was only a molasses tank in the basement. 

conclusions

 

 The feed mill is completely controlled by County zoning because it is in flood plain and shoreline zoning.

OLD BUSINESS:  Discussion on Erdman property

According to the assessor,, the property at 8858 Edgewater Road is being assessed for $28,700 as a basement, a concrete slab and a 10x18 shed. 

conclusions

Send a letter that he will need to get a CUP for 1 year to live there while he finishes the home on top of the basement.   It is not considered an underground home.

old business -  FENCE DISCUSSION

 

Discussion

 Hendricks read the letter from Attorney Selsing.  It was agreed that the Town has the authority to agree that the fence should be set 2’ off the property line in a R-1 district.  It was suggested that it be spelled out in our ordinance fences for agriculture or Residential.

NEW BUSINESS

 

Discussion

 Tom Egan read a letter he received about a business that was started up in town.  He stated the neighbors do not get a long.  It concerned 305 Liberty St in Eureka.  It expressed concerns that it is not zoned commercial, there is increased traffic, the variance to build a garage was not given for an art studio, parking issue and road blockage.

A letter will be sent to cease operation and apply for a Conditional Use Permit.

OLD BUSINESS

 

Discussion

 Kasuboski did receive a building report.  The Board should of set a date when the building had to be moved.  Kasuboski did state he wanted to move the building before the snow fell.

 

A letter should be sent to Tom Schroeder that he has 30 days to take out all the PVC piping on the parcel where the zoning change was not approved.

 

Tom Schroeder has purchased the old grocery store in Eureka and it looks like they are doing work inside.  A building permit was not issued as of yet.  There is no well or septic on that parcel.  It is zoned commercial.

 

Tom Jackson inquired about if we have anything in our ordinance for the placement of trees and shrubs by a property line.  He was wondering if this should be addressed when we go over our ordinances.  Fred explained that this is addressed in the State Statues.
